California Man Settles Personal Injury Lawsuit For Nearly $19 Million After Being Paralyzed by Negligent Truck Driver.

Trucks transport billions of dollars of goods and products across our country, and have become one of the most dependable sources of transportation around.  They are essential to modern commerce. Trucks are, however, significantly larger, heavier, and more difficult to control than any other type of vehicle on the road; this design is to optimize their carrying capacity and is especially true for large, semi-trailer trucks.

The Federal Motor Carrier Safety Administration has reported that trucks in Massachusetts had a rate of serious mechanical violations 41 percent higher than the national average over the past five years.  Adding to that, driver violations were 32 percent higher, and hazardous material violations 212 percent higher, meaning that truck drivers should generally be more attentive and cautious while driving.

When a truck driver operates his or her vehicle negligently, serious injuries or even death may occur.  This is unfortunately what Gary Qualles, from Sullivan County, California, was forced to experience.  Qualles is a professional driver for Jennifer Lopez.  One day, while off duty, Qualles’s car was struck on its side by a water delivery truck for Leisure Time Ice and Spring Water.  According to recordonline.com, the water truck drove through a stop sign at the corner of California Avenue and County Route 78, hitting the side of Qualles’s car at such a high rate of speed that the truck was cut it in half. While Qualles miraculously survived the collision, he was left partially paralyzed and his life is now altered forever.  To recovery for his medical bills and pain and suffering, Qualles filed a personal injury lawsuit against the truck driver and his employer.  Before going to trial, Qualles reportedly settled his lawsuit for $18.9 million, a large portion of which is intended to compensate him for his future difficulties and expenses.
