On April 6, 2016, Cody Layne Hale was driving south on Figsboro road in Virginia. A Comcast bucket truck, being driven by one Rufus Daniel Martin, was traveling in the opposite direction, also on Figsboro Road. The bucket truck allegedly ran off the road, lost control, and crossed the centerline. The truck then crashed into Hale’s car. Hale and his passenger, Rachel Lester, were injured and were flown by helicopter to a nearby hospital. Martin was charged with driving while intoxicated, refusal to take a breath or blood test and reckless driving.
According to the Martinsville Bulletin, Hale’s father has filed a lawsuit against Comcast LLC and Martin. The lawsuit alleges that Martin failed to keep his vehicle under proper control and in the proper lane of traffic. Furthermore, Martin allegedly acted negligently by driving while intoxicated. The lawsuit also alleges that Comcast knew or should have known that Martin had a drinking problem and had a drinking and driving history. The lawsuit states that Hale has suffered excruciating pain and mental anguish and has been permanently injured as a result of the crash. Hale is suing for past and future medical expenses, lost earnings, lost earning capacity and future life care necessities. The lawsuit is seeking $20 million in damages.
