Lawsuit Filed In FedEx Truck And Charter Bus Crash.

The first lawsuit has been filed in connection with the fatal crash two weeks ago near Orland, California involving a FedEx truck and a charter bus carrying high school students to a college visit. Rosa Rivera, the mother of student Jennifer Bonilla, has filed the first lawsuit seeking $100 million in general and punitive damages.

Five students, three chaperones, the bus driver and the truck driver were killed in the fiery crash along Interstate 5. The charter bus had been carrying students from Dorsey High School to Humboldt State University for a college visit. It was 5:40 p.m. when the FedEx tractor-trailer suddenly veered across the center median, clipping a sedan and smashing into the charter bus filled with high school students. Both vehicles burst into flames upon impact.

According to the $100 million lawsuit, FedEx was negligent in operating its vehicles and training and disciplining drivers. There are some witness reports that the FedEx may have been on fire before crashing into the bus. The lawsuit points to a recorded history of FedEx trucks catching fire, either to mechanical problems, driver error or improper loading of cargo. Despite the recognized fire hazard, the company allegedly did nothing to prevent trucks from catching fire. The lawsuit also names the bus company as a defendant, alleging the bus lacked sufficient emergency exits.
