Our interstates, highways and streets are full of truck traffic, including both residential delivery trucks and out of town trailers. In Massachusetts, there are approximately 1,075 truck accidents each year, 34 which are fatal. While the rapid growth of the commercial trucking industry is good news for the trucking companies and the United States economy, it is not necessarily such good news for the cars, vans and SUVs that must also share the road with these massive and potentially lethal trucks. Large truck accident related injuries and fatal crashes are a significant public health problem in the United States today. If you or a loved one has been injured in a truck accident, it is necessary that you contact a Massachusetts truck accident attorney expert right away.
Martin Leon was employed as a FedEx Ground driver. In November 2011, Leon was driving his FedEx semi-trailer truck with another FedEx driver as the passenger. When Leon was done with his shift, he switched spots with Frederico Martinez-Leandro, another FedEx driver. Leon then became the passenger in the truck and Martinez-Leandro was the driver. As Leandro-Martinez was driving, he rear-ended another semi-trailer. Leon was ejected out of the truck, and run over by another truck. He died instantly.
According to the Albequerque Journal, Leon’s wife filed a lawsuit against FedEx Ground. She alleged that FedEx Ground was negligent for allowing Martinez-Leandro to drive while violating numerous traffic laws. The jury deliberated and found FedEx to be seventy-five percent liable for Leon’s death. Leon’s wife was awarded $5.5 million in damages. Attorney Paul Barber represented the Leon family in this civil case.
