One motorist that did not operate his vehicle in a safe manner was truck driver David Gale.  Gale was a truck driver for Everhart Trucking LLC and R&T Trucking and reportedly lost consciousness while traveling down a local road.  Gale’s truck struck a parked sheriff’s cruiser that had pulled over a vehicle because of a speeding violation.  Emily Van Dyke was a passenger in the vehicle that was pulled over.   The car Van Dyke was in was pushed into a ravine by the sheriff’s cruiser and burst into flames. Van Dyke was killed in the accident and her parents filed a wrongful death lawsuit.

A report of the accident stated that Gale lost consciousness behind the wheel of his truck, causing the collision that killed Van Dyke.  The lawsuit alleged that Gale was negligent for driving with a medical condition that could cause him to lose consciousness.  Because he was driving a company vehicle and the accident occurred while Gale was working, his employer was also named in the wrongful death lawsuit.  The insurance company for Everhart Trucking LLC eventually agreed to pay Van Dyke’s family the highest insurance pay out limit possible under the specific insurance policy of $1 million in personal injury damages.
