Illinois Man Awarded $8 Million After Wife Dies in Truck Accident.

Robert Kleppe was a tractor-trailer driver doing a series of deliveries in Illinois when he decided to take an unscheduled detour. During that detour, Kleppe struck and killed Stacey McHale, Steven McHale’s wife, who was standing next to her broken down vehicle. Mr. McHale ultimately filed a lawsuit because of the death of his wife, but Kleppe did not personally have an insurance plan that would come close to compensating adequately the expenses and emotional trauma suffered by Mr. McHale. Therefore, Mr. McHale included Kleppe’s employers as defendants: Kiswani Trucking, which was responsible for delivering the goods from a particular warehouse, and Transfreight, a trucking company contracted with Toyota to make parts deliveries.

Normally, an employer may be held liable for accidents caused by an employee during a work-related activity, but Kiswani Trucking and Transfreight argued Kleppe’s detour was not considered “work-related” and both argued that the other company was his primary employer. Those arguments seem to have proven ineffective; according to, Mr. McHale’s attorney was successfully able to argue that both companies were liable for the accident and secured an $8 million award from the jury.
